    Default Grounds for a restraining order?

    Hoping someone can help me.. My sister passed away last year leaving behind 2 boys, 2 & 4. I have a 4yo and have my nephews most weekends to help my BIL out. His relationship with my mum has been strained since my sister died but no violence or anything. Today he has called me saying he is getting a restraining order against my mum based on her apparently telling a family friend that she thinks he is on drugs. There is no violence, threats, stalking etc, purely based on something my mum said. I really don't want to get in the middle of this but is this grounds for a restraining order? I feel like this is extreme for him to pursue a restraining order over something like this. If he can pursue this can my mum contest it? Help please!

    I doubt it's grounds. He would need to provide evidence and if that's all he's got - especially if it's second hand info or he said / she said, then highly unlikely.

    Thanks ladies, I was hoping my thinking was right. She's just about to start work in aged care so I'd hate for that to effect her police check etc. It sucks

    I wonder if he told you that in the hopes that you'd tell her to leave him alone?

    Maybe. They haven't spoken in over a month so it's just random and overly dramatic :-/
