    Talking Legal eagles - help please

    Just wondering if there are any legal eagles here with knowledge of registering a business name with ASIC and trade marks.... Pretty please I have a few questions

    What did you need to know? I did ours ten years ago but I'm sure it's still as easy!
    Once you have your Abn number you can register your business name on line - and check your trademark and domain names as well to make sure they are available

    My problem is that the name I want is taken already however, it ran out in September 2013 and has not been renewed. The state of ASIC at the moment means that they will not cancel any currently registered business names even if they are not in use. So basically the name is not being used and I can't use it. However, I've heard if I trade mark it then I can use it regardless of it being registered... The trademark is available.

    Otherwise I go with a variation of the name - all of which are no where near as cool as the name I want...

    Have you trademarked your name?

    Well if you own the trademark you do have the only right to that name so yes I would do it if you really want that name - our brand is trade marked and our business name includes the trade mark so we have both
    Just check with your accountant what happens if the people with the business name you want renew it again once you own the trademark?

    Thanks EM! That's exactly what wondering. How difficult/expensive/time consuming was trade marking? Did you have a lawyer do it for you?

    Hi Babyla sorry for not replying last night I was working.

    I wouldn't have a clue about registering names - we get our accountant to handle all of that. I try and avoid the whole area.
