Not sure what section to put this in, so hope its okay in here.
We have a property that we have rented out for the past 6 years to the same tenant. We have used a real estate agency to handle the rent, inspections etc, however we would like to discontinue with the agency and manage the property ourselves.
Does anyone know if we can do this given that the agency were responsible for finding the tenant on our behalf 6 years ago? I cant find a copy of our original tenancy agreement to see what it says.

In QLD you can. You need to check your management agreement that you signed with the agent not the tenancy agreement.
In QLD the notice is up to 90 days depending on what your agreement states.

Yes, I would say so. I've lived in a property where the owner took over management. We, as tenants, had no say or rights when it happened. It was only a couple of months in to our lease.

Just check the date and terms of the management agreement, it has nothing to do with the tenancy agreement. Make sure you have insurance.

this has happened to me, the owners are now our landlords. Can't wait to move now, they're very intrusive. Liked dealing with an agent..

No problem - the agreement should have a notice of termination of agency on it - most are between 30-90 days notice - if you can't find it just call them and ask how much notice you have to give and then write a letter stating something like this:
we would like to terminate the agency agreement with your company and give the required x days notice which expires on xxxxx date , thank you for your service and we will come to the office on xxx date to collect our files , keys and relevant bond transfer documents
You then need to give notice to the tenants the date you are taking over and all your bank account details
The bond has to be transferred, I would do an annual inspection and you will legally still have to issue correct rent receipts , just make sure your up to date with all the legislation ( it changes regularly) and give the tenants all your details so they can get hold of you at any time in case of emergencies

thank you everyone for your replies. At this stage I am unsure if we will do it. DH thinks we should stay with the agency just in case something goes wrong and they have repair people who can get straight on to it.
Oozzle, I promise we wouldn't be intrusive to our tenant. We don't want our tenant to ever leave. He is fantastic. We are actually getting about $80 p/m less than we could be getting, however we don't want to put the rent up because we don't want him to leave. I've had issues with the agency not responding to queries, not actioning requests, delaying on inspections. I just don't think we are getting any real service, except for the collection of rent (so they can take their cut) every month, which is why I would prefer to cease dealing with them.

I have actually had my landlord turn up and bang on my door whinging that I was only one week in advance when I was meant to be 2 weeks in front. She went off her head about how I had ruined their holiday by not putting the extra in, my lease says I need to be one week in advance, not 2..
They are who we have to call in emergencies too so I had to call to report a fault with the kitchen sink, this is 3 days after coming home from hospital after a c-section at 10pm, the whole family came. I was in agony and had the landlords kids wake my kids up, and the landlord kept saying she couldn't believe the mess... I couldn't do anything as I had no partner to help..

If your rent has not gone up in that time it is time for a raise. $10 per week is not unreasonable.
Next look at another agent. And bargain with them. Tell them why you want to change. That you have a good tenant. If your agent now takes 11% ask if the new will do it for 9%
