I had similar - mine was a natural miscarriage at 8 weeks (yolk measured 6 weeks) and then three weeks later I got a positive hpt. I know my hcg level was 140 at 6 days post miscarriage so thought it would be impossible for two weeks later to have enough for a positive hpt. I had a scan and there was no retained products though, and my hcg level was 13. Hpt another two weeks later negative. Based on my experience it is possible that it could still be coming down slowly.
