I have an update! After spending the last 2 days on the phone to everyone from the govn dept that deals with child care centres policies to the antidiscrimination dept, she as an owner has every right to refuse breast feeding in her centre! I told them that it was the first thing I checked when enrolling her in the centre and have been able to do so for the last 2 months how come she can change the policy without it being in writing? I was then told she is allowed to change her policies as she feels. They can only advise her she should deal with it in a different manner and inform parents first, but if she doesnt that is her right. I am disgusted, dumbfounded and outraged. With all the laws in place for breastfeeding these days this one has managed to slip through the cracks. Every child care centre in qld is able to refuse breast feeding within their centre if they feel fit. It is absolutely rediculous! It is not right or fair what this woman has done to myself or my child but unfortunately she is within her means to do so. I got a letter from her today stating this new change and the new policy will be available on Mon for me to look at, so obviously even she knows she is able to do it. Just to add salt to the wound I spoke to legal aid about whether I have to pay the kindy fees as I will be taking my daughter out of the centre and have to give her 2 wks paid notice. I feel as the contract we had has changed I shouldnt have to, but apparently I have to pay her as well! All I can say our govn departments in charge of looking out for children within child care centres has a lot to answer for!!!!
So the next step I will be taking is to lodge an antidiscrimination case against her as the breast feeding association believes I have a case. Lets hope I can at least get somewhere with that!

Wow! I'll be writing a letter to qld gov about this! Thats seriously messed up loop hole that it's not a protected right to breast feed In childcare where your child is.

I'm in qld and I often breast feed baby in the carrier when I pick up jasper. I'd be horrified if they told me to stop and I find it reality disturbing they are entitled to.

THOUGH - I do wonder what their rights are regarding "making" you stop. As in - is it just you can't sue/press charges for discrimination for suggesting you don't feed but you still legally can go "thanks for your input - I'll take it under advisement" and resume feeding. Because the moment they lay a hand on you it's assault so pfft they can actually DO anything and they absolutely couldn't have your child escorted from the premises on a day you have paid for your child to be there.

So... yeah.... I'd put money on they still have no right to STOP you. But they can tell you to stop.

Obviously your best just changing centres.

Lol if it's nearby I'm quite happy to organise a "feed in" at their gates and get some media attention to this messed up loop hole.
