Default Choosing a school for my son

Our private school ( Sydney) has small classes, kindy has 19 and the others average between 15-23 ( 23 being the highest ) but we are under a strict council regulation of no more than 300 kids allowed in the primary school ( which is why our wait lists are high ) I wonder why the councils don't come down harder on the catholic schools and their big class sizes?
