    ALL of his children will be his beneficiaries - both your child and the children from his previous marriage - though I dont know whether you will be considered a beneficiary or not ... it depends on the state laws.

    The exact split up will be determined by the trustee according to a lot of regulations ... I totally agree, you will need a lawyer.

    Remember though - having a lawyer does not have to make it acrimonious - just that it is exceptionally complicated so will take a lawyer to handle it.

    I'm so sorry for your loss. As he has passed intestate you will need to get Letters of Administration from the Supreme Court which will give the person appointed (it can be you, the public trustee, or a solicitor you hire) the power to administer the state. The estate will be distributed according to the intestacy laws.

    It sounds as though the ex is going to be a little difficult judging by her comment so you're going to need a solicitor. But don't worry too much - you're well passed the important time of having been living together for more than 2 years (which is what's required under NT laws relating to intestacy). There are very clear rules as to who is entitled in the case of intestacy and a solicitor will be able to help make this process easier for you.

    Thank you for your responses. I've had a recommendation for a solicitor, and a few more bits of information that have helped calm me - for now. The NT apparently has very good de facto laws, which is a relief.

    We've been to the funeral home here, and arranged what we can to get him home. Just got to go back this afternoon to sign the final bits and pieces. DSD2 and I just set up a Facebook page for him, he didn't have one and there was no central way to get information out or connect with all of the people who knew him otherwise. Next up is calling the funeral home in Darwin to organize a death notice and appointment for tomorrow.

    I sincerely hope everything is settled as peacefully as possible. I'm going to believe it will, but am gaining comfort in knowing a solicitor will be not only helping me navigate the legalities but also help to protect myself and my DS. There is no arguing that each child should get everything they need and are entitled to, I know that is what he would have always intended and it's what I want too.

    Can i stop time please? I'm not ready to face having to restart our lives without him.
