    I'm not sure about this. Whether it varies between states I don't know, but in Vic, if your child is too tall or heavy for the restraint for their age they can use a restraint in the next category. I have a friend with a 3 year old who is exceptionally tall and large (about 20kgs and the height of almost a 5 year old) who is in a booster seat. Obviously it's safer to keep your child in the restraint next suited to their height for as long as possible but from the VicRoads website it seems perfectly legal to use the next restraint up if the size of your child warrants it.

    All states have the same child restraint rules (apart from taxi rules). And it is perfectly legal to move from an inbuilt harness to a booster seat under the age of 4 if your child is too big for a seat with an inbuilt harness. Using an inbuilt harness when you are too tall is dangerous because of the extra downward force on the shoulders. I know of people that have had to do it, and while not the best feeling it is legal.
