    Default Offer to purchase car expired

    My dh signed an offer to purchase a car in June. Subject to finance.
    Finance has taken a while and still not all through but it has been approved but just haven't got the money yet. On the car paperwork it says finance to be sorted no later than 26th June. Now it's August!!so does that mean the contract is now void? Dh now sees a diff car he likes so hoping its easy to get out deposit back and just say finance still hasn't come through so we are canning wanting the car..

    If it says finance by 26 June then yes that's grounds to get your deposit back. You don't even need to say finance hasn't gone through.

    If it says subject to finance approval on the contract you may need to prove that finance did not get approved. It really depends on the dealer. Have they tried making contact?

    It would also depend on the state you are in and if the car has been in stock for that time. If in stock and the dealer has been holding it for you then it may be grounds for them to hold onto the deposit and they would have missed opportunities to sell and also the car sits on their floor plan accruing a cost against the car

    Thanks guys. Luckily this other car was sold! So we will be going ahead. I have contacted the dealership and they were holding the car for us pending the finance even though its been so long. Just had noticed this morning that its well expired!!
