    Yep 12 hrs old and its breaking. By law they have to refund or exchange. Dont take no for an answer!!

    No way!! That is not your only option! Please don't let her try and put it over you. The item is clearly faulty and she is required to replace it for FREE.

    I would go back to where you brought it from, ask for a free replacement as its not your fault she sold you a faulty item, and then state that you will take it further ( not sure what they're called ombudsman? Fair trading sorry not sure, but there has to be some body that looks after this sort of stuff). I would email the company also.

    Go back to this woman and tell her you have done your research/obtained advice and advise her you are entitled to a replacement.

    Be polite, but firm and assertive.

    You not only have a receipt, but you returned it promptly.

    I'd say this retailer usually gets away with fobbing off people, but they are in the wrong here.

    If they still refuse to do the right thing, I'd report them to fair trading/consumer affairs.

    Traders can make up whatever "policy" they like (well actually they aren't allowed to have policy that is against legislation) but at the end of the day we are all protected by consumer protection (see the Fair Trading website in your state). If a product is faulty you are entitled to a refund or replacement. If the shop wont come to the party then just give Fair Trading a call and they will tell you what you need to do usually you can lodge a complaint online) and they will follow it up.

    If they wont refund/replace straight away, I would NOT buy another from them. If you really need a cover now than buy elsewhere and still follow up with Fair Trading to get your money back.

    It is your right as a consumer to get a refund or replacement for a faulty product. Google fair trading in your state and print out the trade practice refund section and take it into the store. If they refuse tell them they will be hearing from fair trading.
    Dont't take no for an answer.

    All the iPhone 3GS cases I bought from those stands and places were crap. The plastic breaks so quickly. You have a right to a refund and I would kick up a fuss. Make sure you are loud and other potential customers hear you. If it was in a centre maybe speak to centre management?

    I just got back from going with DH he finished early from work. I got there and said i wasnt leaving til aomething was done they had a few customers so that really upset her. She the attendant called the owner who then got on the phone to me I explained what happened and she was more then happy to help me. They gave me a full refund and a free silicone case she said she would be giving the attendant a word about their policies as she is severally misunderstanding their refund policy. So is all good thanks for the help

    Well at first she said you can stand there all day for all I care policy is policy but a older lady (looked in her late 40s) who was waiting to get a case for her iPhone told her that she would take her business elsewhere if she fdidnt help me (she was looking to buy 5 iPhone cases for herself and daughters) then the attendant rang the owner. I think that lady helped me on that front and I thanked her for it. The owner herself said that the policy was if you open it and just don't like it there's no refund not for faulty items. Still got the stink eye from the attendant during giving me athe refund and free case but oh wells. The lady who stood up for me didn't end up buying there though
