    Default Help/ Advice re:: Legal stuff.

    Hello, another I need help thread.

    My DSS has had some problems with schooling the last year and at 9 years old has been suspended three - four times. Very bad language is used and basically no respect for teachers etc.

    My husband offered to take him for 12 months to live with us (in another state) and she flat out refused saying she will manage and she would never separate her kids. Also going as low as using the excuse that his wife (me) would never let her call him to talk. (Utter crap as I have NEVER denied access during visits)

    We found out this morning that she has left him at her mothers place after school holidays .... FOR A YEAR!!

    Where do we stand in this? Any legal help would be appreciated as DH has not consented to this at all. No discussion about it, she has just decided to do it without talking it through with his father.

    Go see legal aid/a lawyer.
    I think he should have a say and probably more entitled than her mother to have your DSS.

    Thanks! My understanding is only one party can get legal aid? Wish today wasn't a public holiday so we could get started now. How do we know we qualify?

    Sorry about all the questions we just cannot believe she would do this with no discussion whatsoever and think all is rosy!!

    I've never used legal aid myself so I'm not sure how it works, though because you're in different states I think you can both get legal aid? There are women on here who know more than I do, and who have helpful links which will point you in the right direction. You could try googling legal aid in your state?

    Legal aid can only represent one party. Call them first thing in the morning.

    That's what I thought waterlily, i was sure i had read that on here before! Thank you.

    Would there be something else we are missing? Maybe she knows something we don't? Would she have already called them? Arghhh!! All these questions of the unknown. :-( I cannot imagine any lawyer giving her advise to do this??

    I don't know much about legal stuff I just wanted to wish you good luck.

    I can't stand it when a bitter mother alienates her child from their father/ excludes him from major parenting decisions like this.

    If she had sex with your DP 10 years ago then (unless your DP is an axe murderer!) she should grow up and accept she has to let him into her life for the benefit of the child.
