    Default Spin off.. Is this true?

    My ex recons that its actually ruled that because he is paying child support that technically he can take anything he provides the children while the children are in his care he can take the money out of child support?!! I think he is full of it.... Is that really the case?!?

    Haha!! Never heard that one! Unless it is specifically in your orders.

    No it is not the case. He is meant to provide for the children while they are in his care. Child support is to assist you in caring for the children.

    Nope that's not the case. My father actually tried to pull that one years ago. Csa threw his claim out in court and ordered a huge back pay to my mother.

    Nope. The money a non custodial parent pays takes the time they spend with their kids into consideration... So it's already factored into the rate he pays.

    Exactly this.

    OP if you *need* quick proof, use the online calculators for CS payments. Do a few scenarios with different amount of days fob has your LO, you will see the CS amounts change.

    Its not true ..sounds a bit like he might be trying to trick u .

    The rate he pays is calculated on the time the child in in your care therefore in his care the other portion ...of which he is responsible for paying and providing for that child
