That's assault, no if's or buts. Ok he was being a turd ringing his doorbell, but to slap him 8 times? no excuses for that frankly I think he got off lightly.

    Default Fined for 'smacking'

I'm very much in the 'each to their own' category when it comes to smacking, but this is assault pure & simple. I didn't see anywhere in the article that whether the boy had been spotted as part of the original group - just that he was coming out from behind a gate.

Under the circumstances as described - sounds like the 8 year old had been a pita for a period of several weeks, and he was brought back to his mother and what happened was explained to her, had he slapped my child ONCE I'd probably go yeah don't do that, talk to me, here's my number call me if he's back over there I'm sorry he bothered you do not touch my child in anger. (Though even then it would depend... I might still press charges...)

    BUT

He slapped a child repeatedly across the face. No excuse. No excuse at all in my opinion. That's clear assault unless it's been reported incorrectly.

And I agree he got off lightly. I can't imagine a child being hit in the face multiple times by an adult being anything but a violent assault.

In fact, Derek didn't actually slap the child - the kid blurted that out when approaching his mum, obviously to avoid getting in trouble for ringing the doorbell. The whole case is completely ridiculous - particularly because police resources are being wasted on pandering to this mother's over-the-top demands. In any other suburb or situation, the case would never have been taken to court. Furthermore, Derek was advised to plead guilty to get a spent sentence as opposed to the possibility of a harsh penalty. Now we have a man who's reputation has been tarnished, a kid who's learnt nothing about right and wrong and a mother who thinks the legal system revolves around her

    Does this change your opinion?

It's all hearsay, who knows what really happened.

Slapping 4-5 times on the face is not cool. I have no problem with parents or close relatives giving a child a smack on the bum when they have maliciously done something naughty but slapping over the face is NEVER ok.

Just as the child may be lying so may be the man? I find it hard to believe he would plead guilty to a crime he didn't commit, especially since, from what I read it was a 'his word against his' type of situation.

I believe the child rang his doorbell on multiple occasions and was being a little brat. I also believe he slapped him multiple times.
