    They don't have to have actually had s.ex for him to be charged. Under s215 of the Criminal Code, its an offence to have s.ex or attempt to have s.ex with a minor.

    I think the situation in the OP demonstrates why judges need discretion in sentencing.

    I don't think it's necessarily unfair that he was found guilty. After all he did break the law (or was on course to do so) and he would have been aware of the potential consequences.

    HOWEVER

    I do think it was massively unfair of the girls parents to have him charged and put him in that position. That means that if he does choose to have kids young in life or something that he is not even allowed to do simple things like take them to school, he can't enrol in a number of different degrees at uni or TAFE, he can't even volunteer with an organisation such as the SES because you need to pass a criminal history check and working with children check.

    I think it's unfair....

    However I also think it was well... incredibly ... stupid, for two teenagers to sneak away and fool around at HIS party, where both parents are in attendance...

    Kinda not a lot of brains there....

    Oh, where is so and so... it's his party.... let's go find him... WTF?



    If both parents knew about the relationship and approved then they should have sat both kids down and said "The age of consent is 16 before then there are LEGAL ramifications of sex before then... (to girl) you would be called a rape victim (to him) you would be registered on the paedophile and not be allowed near her for 10 years.. those are the rules of this country .... (to him If you respect HER.., build a friendship, build an emotional connection, kiss and cuddle.... but WAIT till then. (To her): If you respect HIM, build a friendship, build an emotional connection, kiss and cuddle... but WAIT until then. And then when the time comes and you are both mature enough to make it something you've waited and built up and anticipated.. make it special.... and be SMART about it, use protection.

    Unfair. Especially as I bet it wasn't the first time they had fooled around.

    Yes he broke the law, but if the court had to convict hime, I don't agree with him being placed on the register.

    I thought the law was there to protect minors from predators. Not to catch young kids doing what young kids do.

    I think the whole thing is a bit weird TBH. There was the age difference since day 1 and, well, they are teenagers. If the parents weren't happy they should have discouraged the relationship entirely.

    I am hugely surprised that he was charged in this scenario.

    The stupidity of some people amaze me....

    Yes the boy knew she was underage but the parents helped create the situation IMO.

    Unfair. She is just off 16 and there is just 2 years between them. But there has to be a line. I would hate my parents if that were me.
