    A COUPLE and their insurer have been ordered to pay $55,000 in the Brisbane District Court after an elderly aunt slipped on a gumnut while visiting.

    Florence Agnes Welch was 76 when she fell over while walking down the stairs at Tim and Jane Graham's Brisbane home in 2006.
    She sued the couple and NRMA Insurance over claims they breached their duty of care by not ensuring a path was kept clear.


    WOW. NICE AUNTY TO SUE NEPHEW & NIECE. RIDICULOUS. MIGHT STOP HAVING PEOPLE OVER IN CASE THEY STEP ON A LEAF AND TWIST THEIR ANKLE.

    Im not only shocked by the aunty, but shocked by the legal system that she won! What a joke. No wonder insurance premiums are so high!!

    Isn't that why insurance is there? So when people are seriously injured they have a way of recovering their medical costs?

    The way the personal injuries system works these days you don't get aggravated damages - that figure would just be a reasonable estimate of her ongoing medical costs etc.

    She would have to sue them in order to get the insurance to cover it I think?
