    Default Question for a friend. RE: birth cert

    Hi .. I have a quick question for a friend she is pregant and no longer with the father . He is very controlling and so is his dad .. Does she has to put him on the birth cert? Will she get payments if he isnt on there? And what rights does he have if he is on the certificate? He has alot of avo's on his record and alot of other stuff..so its unsafe for bub to be with him. But she is worried he is going to take bub away. Does he have rights to do so with his record?

    I would advise her to not put his name on there. If he isn't listed then no obviously she won't receive Child Support but she will receive her Parenting Payment Single. If he's not listed he has no rights unless there is a court ordered DNA test done to prove he is actually the father, if that is done she may just have to go through mediation.

    She could just say she slept with a few different guys in the time frame and make up names if she doesnt want to put him on there but this could bite her later if she gets back with him

    Tell her to call the domestic violence liaison officer at the police station for advice, plus the family law courts. Not putting him on the birth certificate only delays things, plus means baby has to have a blood test. If he's definitely the dad denying it puts bub through getting a needle unnecessarily. She needs to address the safety concerns and ensure access is supervised. Because if he takes the baby no one can stop him. Unless there's some kind of avo or court order saying he must have limited supervised access. Good luck to her. How scary

    Does your friend have a DVO against her ex? If not she should get one as she will then be able to apply for an exemption from claiming child support without any issues. Once the exemption is in place she will be eligible for maximum FTB payments from centrelink.
    I have been in your friends situation and when it came to signing the birth cert. I wrote 'unkown' in the fathers section and never had any issues when i sent it in.

    I would also write up his info on a paper and seal it in an envelope when she is an adult she may want to know who her father is, health in the family etc. I dont know anything about my dad except his name no medical history or anything I wish I knew more about him.

    Not putting him on the birth cert won't delay anything if she is seeking an exemption from claiming child support.
    Also a DNA test is done with a swab in the mouth, not by needle.

    Also just because AVOs have been in place against him that doesn't make him an unfit parent. AVOs are a civil, not criminal, matter. Her best bet is to get to work on a parenting plan with him ASAP if she can. He has a right to be in the child's life. It's his child too. Sorry but it's true. Unless he is a known child abuser or addict incapable of looking after a child there is no reason to deny him a child and deny the child it's real father, even if it's fortnightly visits, supervised if need be (depending on the circumstances). Record or not he has the same rights to the child as the mother unless he is on the CPR.

    this would not work.

    If you KNOW who you slept with in that time frame centerlink will make YOU pay to dna test all of the men til you get a positive,

    My friend did 3 dna tests before centerlink said she didnt have to do anymore (the father of her child ended up being a baby concieved when she was using a condom) ||
