    Default Banking Ombudsman.....

    is there such a thing?

    In 2010 my husband had his own home based business which took off a bit faster then he thought it would and a lot of his customers were wanting to pay credit/EFT. Paypal fee's were getting out of control so he looked into hiring an EFTPOS machine or something similar.
    He ended up going with an online moto through a bank (named after a town in VIC) which was costing $25 a month to have. This was on a 12 month contract.
    The 12 months ended in December 2011 and he decided not to renew it because the business had died off and he has had a rather good career advancement through his full time job so wants to focus on this.
    He called the banks call centre on Christmas Eve to check that the contract definitely ended which they said yes, and he said he wanted to cancel it all as he would no longer be using it.
    He was told the account was 9c in arrears and to go to the branch and pay the 9c and they will cancel the moto and close the account all in one go.
    Christmas then happened and once that was out of the way, he went into the branch to pay the 9c but was told that Januarys fee's for the moto had been charged and he was now $25.09 in arrears and he had to pay it or he would be charged over drawn fee's and would keep being charged fee's until it was paid. He bought up the point that he had contacted the call centre, was told to come into the branch to do it and that he had already mentioned he wasnt continuing with the moto so why was he charged Januarys fee's. He asked why they took it upon themselves to "renew" the moto without his consent.
    They are ademant he has to pay these fee's but he is arguing that he doesnt owe them because he didnt ask to continue infact he told them he was stopping it.....

    please help?

    Have a look around website and make a complaint if you feel you have a complaint lodge one. Every time a complaint is lodged against a financial services provider they have to pay a sum of money, even if it is eventually determined in their favour.

    You might want to write to them or ring them and let them know you are lodging a FOS complaint as $25 in fees in less than the amount they will have to pay.

    Thanks for the link!!

    They are "reviewing" his case and will let him know on Friday if they ate waiving the fees or not.
    Least now he is armed with the info if they decide he has to pay, he will tell them he is going to lodge a complaint and I'm sure they will change their minds veeeeeery quickly!

    The bank in question are a PITA to deal with.

    We've had countless issues & closed our accounts, so its not just you.

    Your not kidding! We were falsely lured into changing all our accounts over to them only to end up paying $47 on average a month in fees WTF!!!
    Got out of there quick smart but hubby had to hang around until his contract ended!
