    Default What steps to take?

    Need some advice re: DSD who is 6.

    Her mother took off to QLD when she was 4. We're in SA.
    BM applied for DSD's surname to be changed to her husbands but it didn't go through due to paperwork issues.

    BM refuses to let DP have anything to do with his daughter.

    We tried friend requesting DSD on facebook, which is run by BM. We were blocked, and blocked from BM's account also. (although she has DP's entire family on their fb??)

    So what next?
    Do we need to see a lawyer before mediation? Or can we do mediation without having seen a lawyer?

    DP hasn't seen or spoken to his daughter since she was taken away - DSD wouldn't even know him now. She calls the other man Daddy.
    We want access to DSD - but don't know where to start. HELP???

    ETA: there are not & never have been any orders in place.

    You can start the mediation process without having seen a lawyer. I'm in Vic and have dealt with the family mediation telephone service.

    see a solicitor who specialises in family law they'll be able to give info and answer your questions.

    BM should not be able to change DSD's surname unless your DH signs the papers with his signature witnessed by a JP. the only other way is if the court agrees its in DSD's best interests but he'd still have to be notified.

    He did paperwork for her name to be changed but it didn't go through due to not enough ID from my DP. He never followed through with it, so it never got done.

    deffiantly call relationships Australia. They are a wealth of information and do mediation. If the mother refuses mediation you'll be awarded a 601 certificate which enables you to file with the court. Good luck
