Well thats fair enough, I just thought it might be the simplest way if they decided to go through mediation

Ok, thanks. It's better to start slow then build up time to overnight then for longer periods once the child feels comfortable. Courts are unlikely to give immediate shared care, or even immediate overnight visits.

Thanks I know this is going to be a nightmare. Last time he visited he was told what toys he could play with with him, how to hold him how to talk to him and was verbally abused and made to feel like a failure. He set up for his parents to go visit with him and was told they were not to pick him up or approach him, the BM was going to let his sister visit and be involved in his life but wanted her to pay child support too this is not going to be fun but hope we can do something if she thinks she will lose control I bet she bolts with the child what can we do then?

Just for the record - there's no way his sister can be made to pay child support

I'm not sure of all the back story here, but with mediation, if the other party fails to turn up, mediators can issue a certificate stating so and then you just can go to court.

You can get an interim order before you go to court. You also cannot stop the mother doing anything, any time. You can, however, stop her taking the child if she leaves. The sooner you get orders in place, the better.
