    LEGAL CONSULTATION:- It is a requirement under the QLD Surrogacy Act 2010 that the intending surrogate and her partner and the intended parents seek independent legal advice as to their rights and obligations and the implications for any any child/children resulting from a Surrogacy arrangement. QFG will require a written certificate from each legal advisor confirming that they have been advised the couple on their rights and obligations under current legislation. The intended parents would be required to cover ugs own legal costs as well as the costs for the intended surrogate and her partner.

    TREATMENT CONSULTATION:- Arisen throughout the preparatory period. All parties will be required to sign treatment consent forms and the treatment plan is explained in detail. The Surrogacy coordinator team will review your treatment plan with you providing an opportunity for discussion and instruction on the supply and administration of medication.

    6 MONTH QUARANTINE PERIOD:- (Required to decrease the risk of transmission of infectious disease) There are two approaches available, but quarantining is a mandatory step in the process of ensuring the health and wellbeing of the surrogate and her partner. Embryos may be created and Cryopreserved for a 6 months prior to further infectious disease testing and commencement of a frozen embryo transfer cycle. Cryopreserved of the Semen for 6 months followed by a repeat infectious disease screening would enable treatment utilizing a fresh embryo transfer. Your QFG Doctor will inform you of the risks and benefits associated with the prescribed quarantining of embryos or semen.

    PREGNANCY COUNSELING:- The surrogate and partner as well as the intended parents will be required to attend further counseling once a pregnancy is confirmed. This counciling is to ensure that all parties remain comfortable with the plans which have been previously discussed in relation to aspects of pregnancy care including type of care, mode of delivery as well as early pregnancy assessment for fetal abnormality. As part of our duty of care to all parties we have developed our policies and procedures to ensure all parties are prepared and informed as much as possible about the implications of Surrogacy. As with all medical treatment there are risks and consequences associated with assisted reproductive treatment. A surrogate and her family need to consider all of these thoroughly prior to making a decision to proceed with treatment and a surrogate arrangement. It is important to realise this preparatory period may take up to 6-12 months before treatment may proceed.

    Hi,

    Great info and research, if I can just mention that you have indicated that it is legal to receive payment etc, not sure if you are talking about Qld but,

    The Qld Legislation states surrogacy by way of payment is known as Commercial which in Qld is illegal. I have provided a small section from the Qld legislation to outline this.


    Meaning of commercial surrogacy arrangement
    A surrogacy arrangement is a commercial surrogacy
    arrangement if a person receives a payment, reward or other material benefit or advantage (other than the reimbursement of the birth mother’s surrogacy costs) for the person or
    another person—
    (a) agreeing to enter into or entering into the surrogacy
    arrangement; or
    (b) permanently relinquishing to 1 or more intended parents the custody and guardianship of a child born as a result of the surrogacy arrangement; or
    (c) consenting to the making of a parentage order for a child
    born as a result of the surrogacy arrangement.

    22 Making a parentage order
    (1) On an application under this part, the court may make a parentage order for the transfer of parentage of a child to the applicant, or joint applicants.
    (2) The court may make the parentage order only if it is satisfied
    of all of the following matters—
    (vi) is not a commercial surrogacy arrangement;

    Commercial surrogacy arrangements prohibited
    A person must not enter into or offer to enter into a commercial surrogacy arrangement.
    Maximum penalty—100 penalty units or 3 years imprisonment.

    Also, great research on costs and clinics etc, just a little hand on knowledge that there are clinic's in Qld that do not have the 6 month quarantine period and costs do vary from clinic to clinic.
    We have been down the path of researching clinics, lawyers, counsellors etc etc and we are very proud IP's expecting our first bub with the wonderful help of an Angel of a Surrogate.
