I would get advice directly from a solicitor if I was you, it would be too important of an issue to get advice about from someone who wasn't 100% in the know. Good luck with it anyway..

I would be contacting Legal Aid. They have sols who would be willing to give you any advice even over the phone. They would also be able to advise you as to whether or not you need to take legal action and also if you are entitled to legal aid.

I have to agree with the others and encourage you to seek professional legal advice. In addition to Legal Aid there are a number of Community Legal Centres throughout Queensland which operate free advice sessions through Community/ Neighbourhood centres and other Community Welfare Services. Please do a search for a Community legal service or Legal Aid near you.

All I have to say is get onto Legal Aid asap. Even more so if the father is on low income. As only one of you can get help from Legal aid. So its first in. Ring them first thing next week.
Like anyone involved in family law will tell you it's not the paren't who have the right's its the child / children invovled but Like other posters have said your best bet is to contact legal aid they never turn anyone away everything is based off income each client gets a certain amount of funding with the solictor assigned to them if the funding is used before the case has settled you can apply for more funding or pay the expense
