Hello all,
Me & my daughter are invited to a wedding which is in Bali for a close family friend and all my family are going. Plus it is my mum's birthday.
I asked the ex to sign the passport papers and he wont. I understand you have to go to court to get an exemption from having the father sign the document.
Has anyone gone through this process? Any help much appreciated.
Yes he is a right ******* he is only saying no as he is jealous he isn't invited and god forbid his daughter got to see the world without him!

I was pretty lucky with DD's dad when we went to fiji and needed to get her a passport he signed it no problems.
But I know if i was to ask DS's dad to sign paperwork to get him a passport he wouldnt do it.
I don't know what the process is or how long it would take but i hope you get it sorted out.

I don't think you have to go to court.... it reads like you just have to make an appeal and fill in a form. See here (https://www.passports.gov.au/Web/Newppt/Consent.aspx).
What happens if you cannot get consent?
If the consent of anyone with parental responsibility for the child cannot be obtained after all avenues have been exhausted, and there is no court order permitting the child to travel internationally, a written request for 'special circumstances' under section 11(2) of the Australian Passports Act 2005 may be made. An Approved Senior Officer, an officer delegated by the Minister for Foreign Affairs, will consider the statement in support of the request to determine if a passport may be issued without the other person's consent.
In such cases, the passport application must be accompanied by:
a statement made on Form B8 or B9 in which you state why the necessary consent has not and cannot be obtained, and explain the special circumstances relevant to the application, and
the child's full birth certificate, and
the originals of all court orders affecting parental responsibility for the child.

Yeah Im pretty sure you don't have to go to court as a first result either..
I believe that someone from the Foreign Affairs office also try to contact the other parent and sicuss things with them and try to get their permission.
Him "not wanting to sign" is not a good enough reason for him to refuse so he will most likely either have to agree - or have them rule against him for being an idiot.
I have the same problem with my daughters passport - I dont even have it - my ex does, because he's scared I will flee the country with her :laughing: (i'd rather he fleed the country actually)
When it expires I won't be able to get another one because he won't sign it. He just doesnt' realise that when he wants to take her to Bali or something - I won't be signing it either lmao.

I completed a Stat Dec explaining my circumstances and attached that with my DD's passport application. The entire process took around 3-4 months before they approved her passport - but it was issued without the ex's signature.
I could prove we were only going for a particular event (in my case a work conference) and all my family, possessions, work etc were here, so I wasn't going to run off with her.

hello RaryGirl can you give some more info on what was in your stat dec. Also did you have a parenting plan or court orders? I live in western oz. i wonder if it is different over here? i just want to go on a holiday, hell i deserve a bit of bali after all!

Well thats interesting .I DID have to go to court to get a passport for my ds as fob wouldn't sign.
But i notice this thread is 3 years old...:)

Was just wondering, did you go through legal aid? And how long did it take?
