My partner signed a Financial Work agreement thing (shows wage and employment type etc.) for his work. The deal he signed for is completely unfair (they put him on casual, so no holiday, sick leave pay etc &and at a lower rate which was verbally agreed). Anyway we were looking over the contract and noticed that the person who typed it up didn't change the name where my partner was to sign, so the name he signed over wasn't actually his... Is it still a Legally Binding contract or can we request to re-negotiate the deal??
Thanks guys
I'm not really up on legal stuff. Though if the printed name and the name he signed are different, then I would assume that it wouldn't be a valid contract.
Not 100% sure though...
I would have to agree that its not legally binding. This gives him a good chance to dispute anything thats in the contract! Maybe its a sign from above!
I am not an expert on contracts but you might have problems challenging it - the bottom line is that he did sign in and intended to accept the conditions (even thought they were bad). A contract can actually be made verbally - you don't even need the piece of paper - so they might argue that he signed it so he is stuck with it. But it is worth a try - just be prepared that nothing might change.
