My wife is infertile and we both want a baby. My wife's sister is willing to be a surrogate mother and hold the baby for us. I was told by a friend that once my wife's sister has the baby I will have to adopt it into my own family and that will incur adoption costs and laws (such as the law that one of us has to take one year off to look after the child). The baby will have my sperm and my wife's sister's egg, so will I need to adopt this child or will it already be classified as mine? Will I have to adopt the child or is that unnecessary?
I don;t think you will have to adopt the baby as it is biologically yours.
May I ask where you are from and where the surrogacy is taking place?

I would recommend contacting a family law firm in Victoria for some advice before embarking down the path to make sure that you are covered for Victorian legislation etc - each state seems to take a different approach to these things.
