I had a baby 8 months ago (dec) i took maternity leave in november 4 weeks before bub was due. I took 13 months off and am due to go back in january "12". I have just found out that im expecting again, if dates are correct i will be due around april, what happens with maternity leave ?? do i have to hand in my resignation ??? OR will it continue as maternity leave as im entitled to 24 months (unpaid) ??? can anyone shed some light on this for me ? OR does it depend on company?

Depends on the company I think. Could you call the HR dept?

Call Fair Work on 13 13 94. (check out www.fairwork.gov.au (http://www.fairwork.gov.au)) It will depend on what the legislation says - its likely you will be entitled to another period of leave. Don't feel you must resign. Some companies will offer extra benefits but we are all protected by the same basic legislation.

Not sure if it's an internal policy but where I used to work you had to return for six months before you were entitled to another period of paid parental leave, but unpaid might be different...
