Hi,
just want to know what happens to our child support payments if my dp's ex is working but is not reporting it. we have been paying child support for the last 10 years and dp's hours at work are up and down and we may be in arrears. but as it turns out dp's ex wife has been working and even went into business for her self and new hubby and her last tax review was $1,000 for the whole year. we think that she is getting cash in hand and put the business under a family members name, to hide it from child support:mad: what can we do about it,and what happens if she gets found out., another thing, if dp gets cash in hand he can get into trouble, whats good for one, good for all.

it is rather difficult to prove cash in hand work unfortunately. you will need to give child support a call and explain what you think is happening, see if you are eligible for/ request an application form for a "Change of Assessment". It is a bit of a drawn out process but CSA hires people outside the Agency to make a decision on the review of her income and determine her actual income.

As it's hard to prove cash in hand, it may be better to report her to centrelink - ( suspect that if she's only claiming earning $1000 a year then she'll be collecting welfare benefits (more than she would be entitled to).

Centrelink are more likely to investigate this than CSA would be but if centrelink proved she was earning money, then it would be reported to csa, so would help you in a round about way...

If I am understanding correctly your partner is the one paying child support to an ex for his children. Right. If this is the case then the amount of child support he pays wont change even if she declares her income. It is still not legal to not declare money to either tax or centrelink but it wont change the amount your partner pays. Hope this helps. Child support dramas are such a pain.

ive had heaps of trouble with child surrport 1st i was getting $4.21 a month well it was meant to be that but he was getting around $800 a week i was getting $20 for every 4 months i rang them and if u know where he works or what his number is they can find out everything for you but it takes ages i got told i would have to see if i was able to clam it 1st now a year later hos getting more and im meant to be getting $57 a week nothing yet but child surrport dont help like they are meant to but if you have to much trouble ring centre link they help so much

I agree with Caroline it won't make a difference to what your partner pays unless she is earning over $40000 (don't quote me on that). Even then it only takes a very small amount off. I do think you should report her to centrelink though as being a tax payer I don't wish to support someone who doesn't need it. Good luck.

new changes are coming in to effect and it will make a diff as it is going to be looked at evenly

Change of assessment is the only way to get it looked at and from what I have heard they don't look favourably if she is seen to be hiding money, which they will find if she is even if she is writing stuff off on the business. As for it not making any difference, well that depends on how much they deem her to be earning and how ofter your dp has the skids and how much he earns, so if could be worthwhile. Best bet is to give them a call and they will tell you what to do, but good luck, CSA is a law unto themselves and don't seem to make consistant decisions.
