My DP owed a small amount of child support, so when he lodged his tax return, this amount was taken out of his $$$ return and paid to his ex.

It now turns out that because of his ex not filing her tax returns for a number of years, DP may have been overpaying child support (as the CSA didn't have the correct estimate for his ex's income). DP's ex has just lodged her returns for the outstanding years.

My question is, if it turns out she has been over paid by my DP, does this mean the over paid amount will be taken out of her $$$ return and paid back to DP?

In any event, DP is probably going to let her keep any over paid $$$ anyway.

Just curious is all.

Im not totally aware of this issue.. but I think what happens is that he will go into credit...
I dont think they return the overpaid amount to you as such.

You won't get a refund.
You can either let her keep it as extra payments and continue paying your standard child payments otherwise it can go into credit and you won't have to pay until it is all used up.
Say you paid $100.00 extra, and you only owe $30 a month, then you won't have to pay anything for the next 3 months and only $20 on the fourth month.

Each tax return, both your DP and hers it will get adjusted.
