View Full Version : Mum seeks others who have contravened court orders for child safety issues

Hi i am currently contravening a court order and not sending children for access as i believe my children are at risk of harm if i do. i would like to chat to others who have or are doing this also. i am terrified of whats to come so it would be helpful if anyone has gone through the court process to share their story please. i know every family law case is different but the process is similar to how you end up in court. so far its been 3 months and the other party has not served me yet but he eventually will :confused:

Just some advice. You serve him first. The longer you leave it the worse it looks in family court. Basically they think if you really thought the children were in danger you would do something straight away eg...file and application for change of orders and report to relevant authority.

So call legal aid and get advice. The family court takes both child safety seriously and also parents who contravene orders for reasons they do not agree with.

Contact Child Protection in your state as well as a lawyer for advice :)

legal aid has rejected the application so now i am trying to represent myself to change orders. problem is i don't know how to get the records from docs and doctors to prove my case. how do i even get it in the courts to be heard as with no lawyer i havn't a clue. i am in New South wales so thats the state law i am dealing with

child protection hasn't helped in the slightest. he has had a child removed from his care in the past (not mine) regarding mine i have been told no action will be taken as the children in my care so not in immediate danger and they said for me to family law it. i have been ringing them for years for help but none has been given. i feel like the system is letting the children down :(

I would suggest doing everything by the book. It must be hard, considering the potential danger your kids are in, but it could end up much worse for you, if you cannot prove they are in danger and continue to deny access. Are you able to get legal aid?

Or you can't afford one? Are Legal Aid not able to help and onwhat grounds did they dismiss your application?

legal aid rejected as no change according to them to situation to amend orders but i have got new info since last post. I got served today. without legal aid i couldnt afford my lawyer but now we have been served we can reapply which will be done on monday. I have evidence to support my case. photos of bruising and doctors reports on the bruising. also docs records as i have been putting in reports for years others also have made reports. also a child not mine docs records if i can get them. he had a child removed from his care by child protection. it was dv so for years i have been afraid to stand up to him. i am still scared but i am the only one left to stand up for these beautiful children so i have to get past the fear that has held me back
