Anyone had any success claiming back their excess from an insurance agency for a claim that you were not at fault for?

we've had to make a claim for our contents insurance on our investment property due to an upstairs neighbour flooding their apartment and then the water leaking down into the one we own ruining the carpets.
the assesor told me that we should try to claim the excess back as there was no way we could have prevented the incident nor did we contribute to the incident. apparently according to this guy people pay the excess and claim it back all the time. he says our insurance company will chase the other persons insurance company for it or something.

if anyone knows anything or even better if you work for an insurance company please let me know if the above is a possibility. we would love to be able to claim our excess back as were rather annoyed at having to pay it seeing as we were not at fault

we actually got it refunded from our insurance agency once they had received the assessors report. our insurancy agency will now chase the other insurance agency to pay them.

all we had to do was tell them we wanted our excess refunded as the damage was not our fault, once they got proof it wasnt they sent a cheque
