Anyone else sick to death of the idiot federal immigration dept making it so hard for us to stay??? Everytime we finally meet the criteria they have a "SHAKE UP" of immigration and we are exempt again. Why should I have to spend hundreds $$$ on health checks when I already get medicare????

They give us family assistance, they give us FHOG, the even give us baby bonus... but they won't let us sponsor our foreign husbands, or give us any centrelink support (even a health care card) for our severly disabled child..... they are about to win.. we may just have to return to NZ, to a government that will actually appreciate our tax money

I am a qualified teacher, we speak english, we bought a house here, we haven't even had a parking ticket in the 10 years we have lived here, our only downfall is a disabled child who was born here..... WHY CAN'T WE IMMIGRATE????

wow how frustrating! so dd is an Australian Citizen? so they could deport u but not her? thats insane and doesnt she get the disability pension card atleast (technically its for her, but it is a family card)?

thats not fair on you at all!

No she isn't Australian, children born here to overseas parents aren't aussie till they are 10 yrs, technically she is a kiwi

Unless one of the parents are permanent residents then bubs should be automatically aussie... I dont know the special rule for kiwis though.

Funny thing is if I lost my job tomorrow we would get a low income health care card but we aren't eligible for a disablility HCC

This is only if you were not here before 2001, I came here in 2000, and all my kids are Australian citizens (dual Oz and Kiwi actually...)

I'm sorry you are having such a tough time of it! SO frustrating... :hugs:

DH is from New Zealand and has been here about 20 years, no issues at all with staying. Where is your DH from?

DH is dutch... The laws are only different for those who arrived after the 2001 law changes

They can.. as long as they don't mind the no centrelink thing.. and they never actually need disability assistance.. then the government would prefer u go back to where u came from

The rules were tightened up a LOT in 2001. From then on, you have to apply to emmigrate, fill out a 1000 page form (almost) and then if you are accepted, and pay the $1000 or so fee, there is a 2 year waiting period for things like pensions, etc... and there are probably exceptions to that as well...

A LOT of people (even kiwis) don't know much about the new rules, which only keep getting tighter and tighter, and get a BIG shock when they sudenly find they are not eligible for something if they suddenly have a need (My dad had this happen to him...)

That kinda sucks! Especially since Aussies can be granted NZ residency upon arrival in NZ (found this out last month when I inquired at NZ immigration). Obviously things get a bit tricky when you throw in a Dutch person, but that sucks that you can't get centrelink.

I am surprised! I guess though, that NZ has a pretty small population, and is trying to increase it, wheras Australia is trying to control theirs...

Its worse than just filling out a form, both myself and my daughter have to pay hundreds of dollars each to get medical checks, even though we already get medicare, my daughter will fail due to her medical condition, we then have to go to a medical appeals board.... even though we get medicare....WHY?????

Application cost for visa is $2500 for employer nomination scheme.. and I think its amazing if you pay $7500 you can get in with a failed english test, wonder if thats why alot of foreigners get thru immigration without being able to string a sentance together??????

I have enough points to migrate, except I haven't worked full time in my occupation for the past 3 years... because I have been a full time carer to my disabled child... I do work part time but they don't care... where is the flexibilty for good applicants???

OMG that IS full on!!

I think it is just awful you are being denied the full entitlements simply due to health issues, she was born here!!

Is it expensive/difficult to do the appeal? I imagine it will take time, and far out, you have enough on your plate simply looking after your family without all this added stress and uncertainly and lack of support... :no:

I wonder if going to your MP or something could be an avenue??

Been to local MP... he doesn't care... we don't vote.... Australia is doing a GREAT job of keeping out the really bad people like us who work, pay taxes, speak english and don't break the law.. well done for protecting Australia from a 4 year old disabled child who was born here anyway.... New Zealand will appreciate us

Sorry am quite angry about it!!!

Who cares if you speak english or not. I understand you are angry, but you have no more right to be here the any one else.

I hope you get to stay here and enjoy this country just as I hope many non english speaking people will.

In fact I'd love it if they would reduce immagration and increase the number of refugees accepted here.

The immigration dept does care if we speak english... U get extra points for coming from an english speaking country and anyone who doesn't has to pass an english exam for immigration.. So I think its obviously important.

I know I am not anymore entitled... My frustration is at being allowed to come here and work buy a house and have a baby and recieving commonwealth grants to do so....having 130 points to immigrate, then being told.. sorry u only work part time you can't immigrate.... Or sorry your child is medically unstable so you can't immigrate... meeting immigration requirement 3 times then having them change the rules

I think having lots of refugees here would be good too... they go through hell.. but remember you need tax paying workers to enable that to happen

DH is from New Zealand and has been here about 20 years, no issues at all with staying. Where is your DH from?

The rules were all changed in February 2001. DH moved here from Christchurch in 1994 and the laws that govern his residency are completely different to his sister who just moved here (also from Christchurch) with her family in 2010.

DH has far more flexible rules in relation to residency, working, centrelink etc. For my SIL & her family things are much tougher.

Does a child with a disability automatically rule you out of being able to immigrate?

I saw on another thread that you've decided to head back to nz, glad you have found a way forward that you're happy with :)
