We gave our notice to move from the house were in atm back in Jan and 3rd of Feb was ment to be our last day here,

But after applying for a few houses we had no luck and we put it down to other people getting in before us as we both had good references and good jobs.

It got to the point were we seen we were not going to be able to move in time and asked our real estate if we could stay another month and they were happy to have us stay even though they had other people interested in our place.

Anyway, today a real estate rang DP and told him we had been knocked back for yet another house because our real estate told them we had been given a notice to vacate!!!!!!

DP tried to explain to the other real estate that it isnt true that infact we gave our notice and even asked to extend it and was able to, but they said they can only go on what our real estate tells them about us.

I cant believe it, Weve trying for over a month and couldnt understand why we were having so much trouble since we had never had any in the past and it was through no fault of our own, This is the first of 4 real estates to say why we did not get the house we applied for,

Im due in 2 weeks and being induced if he hasnt come by then and I cant believe this is all happening right now.

I have gone through my mail draw and found the letter that said that our notice was recieved and that our last day was on the 3rd of Feb and I also have to the letter we gave them asking to extend our lease and plan to complain but all these real estates dont want to deal with us now.

DP called our real estate to ask them what was going on and they wouldnt tell him anything, Im in shock,

I dont know what to do, I could show our letters from the real estate to other real estates to try a prove that we were not kicked out and that we still live there but Im worried they will think were nuts and there really isnt any real estates left.

I cant believe this is happening to us, We are good people and we have been good tenants and even if this is a acciedental mistake made by our real estate not one done on purpose it has wreaked our chances of renting a house!

It is very possible they have just mucked up because we live in a block of 14 units that are all exactly the same and they manage them all.

I really am in complete and utter shock and am really scared!

Take it further with the your real estate agents. Don't just take a phone call with your individual agent. If they aren't going to help you, go over their heads.

I would go into the real estate with all your letters and documents and complaining, Not just to the receptionist staff but I would be asking to speak to someone higher up

Good luck! I hope it all falls into place and you get a house soon

No, go straight to the real estate licensing board. Not sure who it is in your state, in WA it's REBA. I'm a property manager myself (commercial though) and you can get into big big trouble for doing stuff like that.

Thanks Travdan I will have a google to who handles that in Victoria.

Maybe they will also have some advice on how to correct the wrong information that they gave to the other real estates we applied at.

That sounds atrocious, I would ask to speak to the manager and ask them to remedy the situation. If they are uncooperative tell them you will be pursuing a complaint with consumer affairs victoria and start by contacting the Estate Agents Resolution Service Helpline on 1300 737 030.

No worries, over here, we have a big code of ethics we have to adhere to otherwise you will either have disciplinary action taken against you or you licence cancelled. I imagine it would be similar over there.

We too have been screwed over by our property manager many times, thus we have just bought our first house to get rid of renting all together.

Try VCAT, they should be able to help you

I agree that you need to go higher up, i.e.: ask to speak to the owner of the real estate company and tell them that you have intentions to contact the relevant authorities. The Residential Tenancies Authority might have some information.

I dont think Real estate Agents for rentals should be allowed. They only care about themselves. And dont care about the Tenant or the Landlord. I have been both.

We had a similar problem to you We sold our house to move closer into the city in melbourne we got a house in a beautiful area only through private RENTAL going through the Saturday paper. These people were lovely and we were always 6 weeks ahead in our rent. Well a year later the would not resign our lease because they wanted to sell.

So I had agents coming though taking photos of my private stuff without my consent they put all these photos on a big photo board with our address on the ENTRANCE to the ESTATE for everyone to see.
Lucky we had people through for 2 weeks and it sold and we were given notice to vacate. Look we are always nice and the landlords could not believe the condition the house was in as we had fixed up all the cracks in the walls etc they were thrilled. But we had to find somewhere and quick.

We applied for what ever we could in the area we have school age children and a special needs child so want them to stay at the same school. We were knocked back on every one. Over 50 properties we were knocked back for. When our friends told us they were moving into their own house and we could have the property they rented if we contacted the agent. So they would not have to relist it save them on $$$$$. IT was half the size of what we had and we applied and was called and told that we did not earn enough to rent the property at $240 (this was a few years ago) I could not believe it as we had been paying and provided proof that we paid $260 A week $20 more and we had more services like Aircon HEating etc in the old house. They ended up giving it to us but have been a pain in the BUTT since.

a month after we moved in they decided to sell it so every weekend I have to clean up for OPEN INSPECTIONS which half the time no one turned up for we were call while on our holidays for them to go though Yep no respect. Our oven then Broke it took them 8 weeks to get a new one, The air con in the one room does not work and they have put our rent up to more than we use to pay at the old house. We are hoping we are not kicked out to put higher paying tenants in before we get to move to DH's Mums House.

AGENTS SUX Im really sorry what you a going though I understand how frustrating it is. But In my experience Consumer affairs and VCAT do nothing for people.

OMG, thats awful!

I find that shocking. Doesn't peoples humanity kick in when they see someone literally on the verge of having a baby?

I refuse to understand how some people think in this world, I really do.

Im thinking next time you apply for a rental, photocopy your letters and paperclip them to the rental forms you hand in. That will stuff your old real estate! how dare they do that to you!!!
