Hi, just wondering if anyone can help me? I'm not sure of the legal side of things with guardianship, and we are just at the begining of finding things out. Our friend is a single dad whos wife died 2 yrs ago and he has a 3yr old boy. He has only been in aus 10 weeks and doesn't speak english. He has stage 4 cancer, and is about to go into hospital for 7 weeks. He would like us to have his son from monday to friday for those 7 wks. Is this ok? can we do this? Also he has asked that if something happens can we look after his son - how do we go about making this ok? I feel so out of my depth! Both him and us are aware that there is a high chance that he may not be around much longer, but to make anything official feels like it makes things too real. If anyone knows anything, advice would really be appreciated! thanks so much.

He needs to see a lawyer as soon as possible. He needs to sort out a will and name you as legal guardians for the long term if that's his wish. If he doesn't do that it could get quite tricky if there is no family for the child in Australia. It's also probably quite tricky as the child I assume is not an Australian citizen.

This is a very complex legal issue and it must be sorted out by a lawyer as soon as possible. If the father has stage 4 cancer then he should see a lawyer this coming week if he can as he might not have the strength to do it later.
