Hi guys, im not sure if there is a more appropriate section for this but i thought id plonk it here. I bought a pair of pants from David jones 3 weeks ago. The second time i wore them which was about 4 days later, i was getting in my car and they tore. Not along the seam but from a seam and out (in other words cant be repaired). So i took them back to david jones and initially the lady said 'yes that looks like fault you shoudl be able to just exxchange'.

She then went to get them checked by another lady who then said no they need to be sent off to be assessed if its a fault or not?!

So i signed some little form and she said we will get back to you in a couple of weeks. I said to her, so if it is not deemed to be a fault i dont get a new pair? and she just looked at me and said 'well we will just see what they say.'

Now they havent got back to me yet, It will be 2 weeks on Monday but i want to know if this is allowed. I am going to be MAJORLY peeved if they tell me i cant exchange, as there is no way they can be fixed and they are brand new!! They werent too tight either, in fact they are baggy in the bum so i just dont understand how they can deem it not to be a fault (if they do). Is there anything i can do if they dont let me exchange? I thought these major chains were always good with stuff like this, i know myer would just exchange them straight away!

Sorry i know its not the end of the world and its only a pair of pants, but im going to go in and check about them over the weekend and want to be armed with any advice, or if anyone knows if this is even allowed or are they just taking advantage of a tired, brainless new mum

Not sure if im going to be of any help but i have a friend who works at david jones. I borrowed a pair of her sass and bide shorts and the metal button popped off. When i gave them back to her she said dont worry, its obviously a fault but because its sass and bide i will have to send them back to assess the fault. She got them back later, they deemed the button to be faulty and repaired it.

Hopefully you get some news soon, maybe try giving them a quick call to track the progress :fingerscrossed:

Depends in the manufacturer & their policy. Some will exchange no worries, others will want to 'asses' the garment before it can be exchanged.

I used to work in retail & had some issues with some companies. Billabong would credit us no worries after we had exchanged the garment for the customer in store.

I would ring them to see what happening, saves you a trip in over the weekend.

Nope- I wouldn't be standing for that at all! It surprises me actually because DJ's are usually really good with stuff like thta. Unless you just got someon who was having a bad day.....

Call Consumer Affairs- they'll be able to help you and at least then too, when you go in over the weekend, you'll be able to 'mention' Consumer Affairs and what they have said. It might be the difference in them refunding and exchanging or 'repairing'.

Good Luck.

oh thanks guys, i felt really petty asking about this so thanks for the responses. So they might be sending them back to the actual company they came from, i didnt think of that. I thought they were sending it maybe to their own 'david jones' assessors or something. Ah well that gives me a bit more hope. Consumer affairs thats the place i was trying to think of, thats who i thought i should call if they send them back without refunding. Thanks again, It just annoys me coz they were a hundred bucks and id rather throw it to the seagulls than waste it on pants if i cant wear them!
