Just wondering if I have my 1 & 2 yr old living with me 90% of the time, what are my chances of been allowed to move overseas, I ask because I have 4 mths left to finish my studies in canada, and I would like to go back and finish my diploma, I have asked universities here to see how much credit i would get, unfortunately i would only get abt 4 subjects worth which would mean I would still have 2 1/2 yrs fulltime study, so logically it would be better if I were allowed to go back.

If you only intend to go back for those 4 months, then you may have a good chance.

You would be required to provide a return air ticket for you and your bubs.
You would most likely be denied rights to move back there permanently unless there were extreme circumstances.

Go and see legal aid and ask them directly - explain the situation to them and see what they say.

Is your ex likely to make a huge fuss about it??
Does he see the kids often enough for him to say that he wont get to spend time with them?? and do you have people over there to support you whilst you study? and can you afford it? will you be able to cope financialy? its a big step think it through big time before you do it.
