JOHN Howard's industrial laws were branded a shambles last night, with the revelation that half of all wage deals checked by the Coalition's workplace watchdog have failed the "fairness test" and been sent back to employers for correction.
The Workplace Authority confirmed 26,833 agreements had been knocked back for failing to comply with minimum standards since the Prime Minister introduced the fairness test in May.:thumbsdown::thumbsdown::thumbsdown:
I think this demonstrates the WorkChoices system is fundamentally flawed - if that many agreements are failing, clearly people don't understand the laws or aren't able to negotiate effectively enough to even meet minimum standards.
What do you think?

I am 100% against these IR laws, I know someone who was personallly $7 worse off an hour, and he wasn't in a highly paid job to begin with. It is fine if you have a decent boss who doesn't want to screw you over, but too bad if he does....it is now legal to do so.
My DH's boss is voting Labor in protest to the IR laws, he is a great boss who treats his workers well, but is very worried about business owners who will take advantage of these laws.
Also doesn't the fairness test apply to AWA's for existing employees only? So if around half of them are being found to be unfair, you can only assume that half the new employees will be treated as unfairly as they can under the IR laws.
Why am I not surprised?? :rolleyes:
Anyone who thought that there were employers out there that wouldn't take advantage of the IR laws is delusional.
One of the biggest employers to take advantage of the new laws is the Federal Govt itself (the current Govt) - it offers all new DEWR employees a crappy AWA, with the whole "sign it or don't work here" line. :thumbsdown:
Where I am we have a choice between being employed under an AWA or Certified Agreement. They're the same conditions but if you wish to negotiate giving up some leave for higher pay etc you're able to do so under the AWA. It gives employees more choice. I don't know anyone struggling under an AWA but I am worried about any IR changes Labor might put into effect, esp with more union involvement.

Wow, you get a choice! That's great for you and the others that work there. :) I know many that don't get that choice, it is AWA or no job.
The only thing that I worry about is that the changes to the IR laws that Labor might make won't be enough.:no:
