Is it illegal in S.A.? I was on another thread about surrogacy and call me nieve, but couldn't believe this could possibly be illegal :thumbsdown:
Anybody have any info?
I have a strong suspicion that it is.
Traditional surrogacy is illegal all over Australia, but gestational surrogacy is legal in WA, ACT and NSW. You can also be a gestational surrogate in Vic, but the surrogate must be deemed infertile - a pretty steep hoop to jump through.

You can donate sperm or eggs which genetically is a part of you, but you cant CHOOSE to grow a baby in your womb if you want too do that for a couple that cant... :confused:

Yep - very ironic and hypocritical....
However, it's not controlled by the Federal Govt - it's all controlled by legislation at State level.

No joke, I'm sitting here like this :confused: I've never heard of this before, just thought you could be a surrogate if you wanted too.

It is sad/scary/hypocritical/controlling that a govt can tell you what you can and can't do with your own body....
Surrogacy does happen in Australia - and a lot more than you would probably think and realise.
Oh - forgot to say too that in Tassie, it's not illegal, but it's not really legal either. The hassle in Tassie is actually finding a specialist who's willing to be heavily scrutinised to treat you.

So lets get this straight, If I CHOOSE to be a surrogate, I would have to travel interstate to get impregnated, come back home again, then go over there to have the baby? Then its legal?
Gawd if we had a woman as our Prime Minister, this wouldn't be an issue.
I'm going to look more into this, it seems very very odd to me :hair:
Generally, you need to be a resident of the state in which it's legal to get treatment.....

I agree with moonblossom I would love to be a surrogate but will look nto it further when the time comess

I saw a thing on telly once about surrogacy here in Australia and there were sisters who lived in a state where it was illegal, somehow sister 1 carried for sister 2 anyway but with the laws the way they were in their state it meant that although it was sister 2's daughter and she raised and cared for the child, any legal stuff and decisions legally had to be made by sister 1. Sister 1 was the legal parent of the child because she carried her but as far as she was concerned the child was her sisters. It's weird and absolutely unthinkable that people can make these kind of personal decisions for others. It's up to the people involved i think and if there all ok with it then who is the government or anyone else for that matter to say they can't do it.
I hope that all made sense.
I would consider being a surrogate mother as long as the egg and sperm were the mother and fathers. That way it has nothing to do with me. But I'd probably do it for my sister and my best friend
